Empathy
All discussions, whether private or not, are listened to carefully and non-judgmentally. I want all parties to feel their position is heard and understood. Empathy lets me discern how a party feels and how these feelings may impact the mediation.
Enthusiasm
An easy way to get someone to respond positively is if the mediator communicates enthusiastically. Most of us have experienced mediation where the mediator simply goes through the motions of "back and forth" where little is accomplished. Enthusiasm can be expressed by being attentive, and using positive body language and verbal cues. It is important to show enthusiasm when the party reveals key information or offers a possible resolution to the case so that the party will continue acting in this manner. Remember the goal of any successful mediation is to reach a settlement everyone can live with
Equality
Strong and meaningful verbal communication is important in a successful mediation. Both parties should feel that the mediator is speaking to them parties individually with a sincere and goal-driven attempt to settle. Maintaining eye contact and finding ways to infuse more personal attention in the case can help the parties connect with the mediator. My role has not been accomplished unless a settlement is reached.
